A UNISON member returned to work after a shoulder operation, their workstation had been ergonomically and set up so that it was suitable for his disability. With the introduction of ‘hot desking’ the member was forced to use workstations that were unsafe and unsuitable for their ergonomic needs. The member then suffered a aggravation of the existing medical condition.
Thompson’s solicitors took the on the case, a claim was made and a medical report obtained in support of the member’s claim.
As no offers in settlement were put forward by the Council insurers Thompsons commenced court proceedings. During the proceedings negotiations resulted in a satisfactory settlement being agreed with the member accepting an offer of £5000.
Thompson’s and UNISON made no deduction from this settlement and the entire amount was paid to the member.
